Terms of Service

Effective date: 23 October 2026 ·  Last reviewed: 23 October 2026

Please read these terms before registering or ordering paid access. They describe subscription features, permitted use of materials, payments and your rights.

This version applies to new registrations and orders from the effective date. The terms of previously paid orders and mandatory user rights remain in force.

1 Operator and contract formation

NITI Music, available at https://nitimusic.pro, is operated by Aleksei Dekin pr Beograd, an entrepreneur registered in the Republic of Serbia. Address: Rada Neimara 73, Voždovac, 11107 Beograd, Srbija. We use the terms “Platform” and “we” below. Contact and registration details appear in section 14.

These terms govern accounts, catalogue access and the features included in your selected plan. When registering or ordering paid access, you expressly accept the terms before completing the relevant action. Visiting the website alone does not create an obligation to pay for a subscription.

The terms of your particular order, displayed before payment and included in its confirmation, form part of the contract. If they differ, they take priority regarding the price, duration and scope of the purchased features. Mandatory law takes priority over all contractual provisions.

Personal data processing is described in the Privacy Policy. Acceptance of these terms does not constitute consent to optional data processing or advertising.

2 User requirements

You must be at least 18 and have the necessary legal capacity to register and purchase a subscription. If acting for an organisation, you confirm your authority and provide accurate customer details.

The service is available to anyone who meets the age and legal capacity requirements. Professional DJ status is not required. Paid features become available after payment for the relevant subscription is confirmed. Buying a subscription does not by itself make a user a business customer or remove mandatory consumer rights. Materials may be used only in accordance with section 5.

3 Accounts and security

One person may use one personal account unless we separately agree otherwise. Selling, transferring, renting or sharing an account or sign-in credentials is prohibited. You must protect access to your email and account and report suspected unauthorised access promptly to Musicniti.info@gmail.com.

You are responsible for your actions and for breaches caused by your culpable failure to protect access. An action originating from your account does not by itself establish your fault or exclude our statutory responsibility for security.

Where there are signs of account compromise, fraud or a material breach, we may temporarily restrict access to the extent necessary. Grounds, notice, review and termination are governed by section 10.

4 Subscriptions, payments and refunds

The price, taxes and mandatory charges, access period, available formats, download limits and reset periods are disclosed before payment. Subscriptions include full playback of available audio and streamed video within the relevant plan. Technical requirements and material restrictions must be available before ordering.

The download allowance applies to the full term or resets each subscription month, as stated in the order. Each repeat download counts separately. A download is counted when transfer begins; a new attempt normally counts again. If a Platform error prevents delivery or causes an incorrect deduction, contact us for investigation and restoration of the relevant allowance. Unused downloads do not carry over unless expressly stated in the order.

Each purchase is a one-off payment for the selected term, with no automatic recurring charges. Ordinary early renewal, including a different plan, adds the purchased term after existing paid access without resetting the current allowance. When the active download allowance is exhausted, you may instead select “Start a new period now” and expressly confirm the displayed conditions before payment. On confirmed payment, that current allowance period ends early without carrying over its remaining days, and the selected plan starts with its full term and allowance. Future prepaid periods, including later months of an annual subscription, are preserved and rescheduled after the new plan with their purchased terms unchanged. If the selected period has already ended or changed by payment confirmation, the purchase extends access without resetting the current allowance. Dates shown before payment are estimates based on the confirmation time; the actual dates and outcome appear in your account and payment history. Failed or unconfirmed payments do not change subscription periods. These options do not limit mandatory rights described below.

Available payment methods are displayed during checkout. If a price is quoted in EUR and a card payment is made in RSD, conversion uses the official EUR/RSD middle exchange rate published by the central bank of the Republic of Serbia at the time the order is created. The RSD amount is fixed for that order and displayed before payment. If payment using digital assets is available, the asset, network, amount, exchange rate, payment deadline and applicable fees must be shown before confirmation. Use only the payment details for the particular order.

Paid access is activated after successful payment is confirmed. If payment has been made but access is missing, a payment is duplicated or another error occurs, send us the order number or other evidence. We will investigate and provide access or a refund where due. A new plan or price change does not worsen an already paid order. We give at least 30 days’ notice of increases to future subscription prices.

If you are a consumer entitled by law to withdraw from a distance contract, you may withdraw without giving a reason within 14 days of entering into the contract. Longer statutory periods apply where required information was not properly supplied. Send an unequivocal statement to our email or postal address; using a particular form is not compulsory.

For digital content supplied without a tangible medium, the withdrawal right may be lost after supply begins only where all statutory conditions are met, including your prior express consent to supply before the withdrawal period ends, acknowledgement that this causes loss of that right, and provision of the required contract confirmation. Acceptance of general terms alone is insufficient.

For a continuing service, activation alone does not mean full performance or loss of the withdrawal right. A charge for the part actually supplied following withdrawal is permitted only where provided by law. Loss of the right to withdraw without reason does not remove remedies for non-delivery or lack of conformity, including restrictions caused by third-party rights.

Send complaints to Musicniti.info@gmail.com or use the details in section 14, describing the problem and providing available order evidence. We acknowledge consumer complaints promptly. We respond within eight calendar days, stating our decision, reasons and, where the claim is accepted, the method and deadline for resolution. Mandatory resolution deadlines are observed, including 15 days where required by law. Complaints are recorded and retained for at least the mandatory period.

A consumer refund due on withdrawal or termination for non-conforming digital content is made without undue delay and within the statutory deadline, normally within 14 days of the relevant notice. We use the original payment method unless you expressly agree to another method at no additional cost. We do not charge for such a refund. A business customer who is not a consumer has no change-of-mind refund right; remedies for breach remain available.

Contacting us may resolve an error faster, but is not a prerequisite to contacting a bank, court or competent authority. A good-faith payment dispute is not a breach. Deliberate fraud, fabricated payment evidence and double recovery are prohibited; any allegation of such conduct must be substantiated.

5 Intellectual property and permitted use

Rights in works, recordings, performances, videos, images, identifiers and software belong to their respective holders. A subscription does not transfer ownership of those rights or imply endorsement of the Platform by an artist or rights holder.

While your subscription is active, you may use listening, viewing and permitted download functions for lawfully available materials for personal evaluation. Any permission to use a particular material applies only within the rights we are entitled to grant. Permitted uses, territorial restrictions and the duration of permission are disclosed before obtaining the material and, if material to the order, before payment. Material without a confirmed lawful basis for the relevant method of supply must not be included in the accessible catalogue.

A subscription does not by itself grant rights of public performance or display, DJ performance, commercial use, adaptation or distribution. Those activities require an independent lawful basis, including the necessary permissions from rights holders. Limiting the purpose to personal evaluation does not remove our obligation to have a lawful basis for hosting and supplying materials through the Platform.

Without a separate lawful basis covering the relevant rights, you may not give files to others, resell them, upload them to publicly accessible storage, independently distribute them, broadcast or webcast them, publish them on social media, use them in advertising or incorporate them into new audiovisual works. Removing rights notices or circumventing technical restrictions is prohibited except where expressly permitted by mandatory law.

Payment, downloading, crediting an author or labels such as “for evaluation”, “remix” or “promo” do not create missing rights. When your subscription expires, access to the Platform’s paid features ends. Rights independently and lawfully obtained from another source and rights under mandatory law remain unaffected.

A rights holder or authorised representative may report infringement to Musicniti.info@gmail.com. Please identify the claimant and contact details, the work or other protected subject matter, the exact link or identifier of the disputed material, the rights allegedly infringed and the basis of the claimant’s authority. Supporting evidence helps our review; copyright registration or a prior court decision is not a universal prerequisite.

We review notices without undue delay and may temporarily restrict disputed material while investigating. Where infringement is established or a binding order applies, access is disabled within the statutory deadlines. An incomplete notice does not justify retaining manifestly unlawful content. Access may be restored where there is a sufficient lawful basis. Information is disclosed to participants and authorities only as necessary and on a lawful basis.

6 Prohibited conduct

Unlawful use, unauthorised access, malicious code, disruption or excessive load, circumvention of allowances or restrictions, unauthorised automated bulk extraction or downloading, impersonation, threats, harassment and infringement of third-party rights are prohibited.

Assisting such conduct, sharing private access links or using multiple accounts to bypass rules is also prohibited. These restrictions do not remove rights expressly granted by law.

7 User materials

If you are given upload functionality, you may submit only materials for which you hold all necessary rights, including rights in underlying works, recordings, performances, images and adaptations. On a justified request, you must provide information supporting your authority. A remix creator’s permission does not supply missing rights in underlying elements.

You grant us a non-exclusive, royalty-free permission to store, technically process, reproduce and display your material as necessary for the function you selected. Streaming or downloading by other users is permitted only to the agreed extent. Ownership remains with the rights holder. Use in a separate advertising campaign requires a separate basis.

The permission lasts while the material is hosted and for a limited period necessary to remove technical copies or lawfully retain evidence. It does not permit new public use after publication ends. We may restrict or remove material for breach of law, these terms, third-party rights or security requirements, and give reasons where legally permitted. Substantiated repeated breaches may result in account closure.

8 Platform liability

We must provide the agreed features and comply with mandatory requirements for digital content and services. Technical interruptions and catalogue changes may occur for justified reasons, including security or expiry of rights in materials. This does not remove statutory or contractual remedies for non-delivery or a material deterioration of paid access.

We do not promise particular earnings, suitability of materials for a commercial project or compatibility with every device. Users must consider the technical requirements disclosed in advance. These provisions do not exclude liability for failure to meet the Platform’s specific promises or mandatory legal requirements.

Only for business customers who are not consumers, and to the extent legally permitted, liability for indirect losses and lost profits is excluded. For paid business access, total contractual liability is limited to that customer’s payments in the 12 months before the relevant event, provided that the limit is lawful and not manifestly disproportionate to the damage.

The limits do not apply to intent, fraud, gross negligence, death or personal injury, or other liability that cannot be limited. They do not remove mandatory consumer rights, repayment of sums due or claims by rights holders who are not parties to this contract.

9 User liability

Users are responsible for proven culpable breaches of their obligations under applicable law. A business customer must compensate documented reasonable costs and losses directly caused by its breach, including unlawful file sharing or uploading without rights, to the extent legally permitted.

Compensation does not cover losses caused by our own breach. We provide timely notice of third-party claims and a reasonable opportunity to participate in the defence. Users are not required to fund claims we arbitrarily admit or a settlement they have not agreed to that imposes obligations on them. Consumer liability is governed by mandatory law.

10 Restriction and termination

Access may be restricted on reasonable grounds to suspect account compromise, fraud, rights infringement, account sharing or a material breach, or to comply with law or an authority’s order. Measures must be proportionate to the reason and necessary scope of protection. Urgent threats may require restriction before notice.

Where legally permitted, we explain the reason, affected functions and how to request review. If a breach can be remedied and delay creates no material risk, we allow a reasonable opportunity to remedy it. Material or repeated breaches may result in account closure. You may challenge a decision through our contact address.

If we terminate paid access on our initiative without a user breach, we refund the amount for the undelivered portion. Following a user breach, sums may be retained only to a lawful and justified extent; the entire payment is not automatically forfeited. Lawful claims for damages remain available.

You may close your account by contacting Musicniti.info@gmail.com. Closure alone creates no additional change-of-mind refund right, but does not remove rights under section 4 or the law. Provisions concerning accrued obligations, protection of rights and disputes survive to the extent required by their purpose.

11 External providers

We may engage providers of website hosting, file storage and delivery, authentication, communications and payment processing. Information about personal data processing and recipients is provided in the Privacy Policy.

If an operation requires a separate agreement with an external provider, its identity and applicable terms must be available before confirmation. Engaging contractors does not release us from our contract or mandatory liability. Independent offers on external websites are contracted with the relevant seller; this does not limit our responsibility for our own actions.

12 Governing law and disputes

The contract is governed by the law of the Republic of Serbia. If you are a consumer, this choice does not deprive you of protection under mandatory rules applicable to you, including those of your habitual residence where required by law.

We suggest contacting us first to seek an amicable resolution. Correspondence and negotiations do not prevent recourse to a bank, competent authority or court and do not shorten statutory enforcement periods. Out-of-court procedures are available where provided by law, and we participate where required.

Business disputes are subject to the competent court in Belgrade unless mandatory law provides otherwise. Consumer jurisdiction is determined by applicable mandatory rules, without contractually removing access to a court available under those rules.

13 Changes and general provisions

Terms may change for justified reasons, including changes in law, security or service features. We give email notice of material changes at least 14 days in advance unless a longer statutory period applies. Urgent changes required by law or to address threats take effect when necessary, with notice as soon as possible.

Changes are not retrospective and do not arbitrarily worsen paid terms. Where law requires separate consent or permits termination and a refund for materially changed services, those requirements are observed. Continuing to visit the website does not replace mandatory separate consent.

An invalid provision does not invalidate the remainder if the contract can operate without it. Failure to exercise a right is not a waiver. Additional notices and disclaimers cannot override mandatory rights or the terms of a paid order. The contract version in the language selected at formation is included in the order confirmation; translation does not limit mandatory user rights.
